Bringing a case to the European Court of Human Rights – A practical guide on admissibility criteria

(20/08/2012)

The European Court of Human Rights is currently overloaded with cases (there were almost 150,000 pending applications at the end of March 2012). Some 90% of all applications are eventually declared inadmissible. Such cases clog up the Court’s docket and obstruct its examination of more deserving cases where the admissibility requirements have been satisfied and which may concern serious allegations of human rights violations. The 2010 Interlaken Conference on the reform of the Court called upon the “States Parties and the Court to ensure that comprehensive and objective information is provided to potential applicants on the Convention and the Court’s case-law, in particular on the application procedures and admissibility criteria”. The Court’s first response to this call was to prepare this practical guide on admissibility criteria. The guide seeks to reduce the number of obviously inadmissible cases by enabling legal practitioners to properly advise their clients on their chances of bringing an admissible application. This second edition covers case-law up to the end of March 2011. In addition to this guide the Court has launched a short video as well as an interactive admissibility checklist. These tools are aimed at providing lay applicants with more succinct information on the admissibility criteria.

Submissions to the UN CLCS of Disputed and Undisputed Maritime Boundary Delimitations or Other Unresolved Land or Maritime Disputes of Developing States

(Vandeplas Publishing 2012)

Barbara Kwiatkowska

This pioneering book surveys fundamental principles of not prejudicing by the UN Commission on the Limits of the Continental Shelf (CLCS) of Disputed and Undisputed Boundary Delimitations or Other Unresolved Land or Maritime Disputes under UNCLOS and the CLCS Rules. It constitutes a remarkable contribution by one of the world’s leading academics in the field of international law of the sea to peaceful resolution of oceans and boundary disputes within the framework of the UNCLOS and the United Nations Charter.

A New Blueprint for a Green Economy

 (Earthscan 2012)

By Edward B. Barbier, Anil Markandya

Published in 1989, Blueprint for a Green Economy presented, for the first time, practical policy measures for ‘greening’ modern economies and putting them on a path to sustainable development. This new book, written by two of the Blueprint for a Green Economy authors, revisits and updates its main messages by asking, first, what has been achieved in the past twenty years, and second, what more needs to be done to generate a truly ‘green economy’ in the twenty-first century.

……

Environmental Governance Of The Great Seas: Law and Effect
(Edward Elgar, 2012)

Joseph F.C. DiMento and Alexis Jaclyn Hickman

The authors of this comprehensive study provide a rich assessment of the condition of the seas and the efficacy of the initiatives governing them. The aim is not only to describe and evaluate existing governance structures, but also to indicate how governance can be improved. Case studies of the Baltic, Mediterranean, Black, Caribbean and East Asian seas illustrate the varying degrees of policy success, failure and promise.

International Law In The Era Of Climate Change
(Edward Elgar, 2012)
Edited by Rosemary Rayfuse and Shirley V. Scott

‘UN Secretary-General Ban Ki-moon has called climate change “the defining issue of our era”. It presents international law and lawyers with a wide range of novel issues, practical as well as conceptual. These challenges are addressed in this volume with great authority by many of the leading international law scholars of our generation. It is an important and distinctive contribution to the burgeoning literature on an issue critical for the future of our planet.’
– David Freestone, George Washington University, US

An Introduction to Transnational Criminal Law
(Oxford Univ. Press, 2012)

Neil Boister

States criminalise a wide range of transnational offences, such as piracy, human trafficking, drug trafficking, terrorism, organised crime, and cybercrime. This book provides an introduction to this developing area of law, setting out what transnational crimes are, and how states can establish jurisdiction over them and enforce it.

……

How Interpretation Makes International Law
On Semantic Change and Normative Twists
(Oxford Univ. Press, 2012)

Ingo Venzke

An account of how the practice of interpretation makes international law, drawing specific attention to the increasing authority of international courts and institutions, this book analyses the role that the language plays in shaping international law. It addresses the key issue of how it contributes to the evolution of international norms.

Environmental Policy in the EU

Actors, Institutions and Processes – 3rd Edition

(Taylor and Francis, 2012)

Edited by Andrew Jordan and Camilla Adelle

The European Union (EU) has a hugely important effect on the way in which environmental policies are framed and implemented in many different parts of the world, but especially Europe. The new and comprehensively revised edition of this well-known textbook provides a state-of-the-art analysis of all the EU’s environmental policies. Comprising five parts, it covers the rapidly changing context in which EU environmental policies are made, the key actors who interact to co-produce policy and the most salient dynamics of policy making, ranging from decision making through to implementation and evaluation. Written by leading experts in the field, individual chapters examine how the EU is responding to a multitude of different problems including biodiversity loss, climate change, energy insecurity, and water and air pollution. They tease out the many important ways in which the EU’s policies on these topics co-evolve with national and international environmental policies. In this third edition a mixture of learning features are employed to ensure that undergraduate and postgraduate students fully understand how EU policies in this vital area developed in the past and how they are now adapting to the rapidly evolving challenges of the twenty-first century.
